4.3 If there is a breach of an implied warranty or condition related to goods, Motivated Vendors' liability will be limited to:
  1. The replacement of the goods or the supply of equivalent goods;
  2. The repair of such goods; or
  3. The payment of the cost of replacing the goods or acquiring equivalent goods, or having the goods repaired.
4.4 In no circumstances will Motivated Vendors be liable to you for any indirect, incidental, special and/or consequential losses or damage or loss of profits of whatever nature howsoever arising, which result from the use of the Website.

5. APPLICABLE LAW

5.1 This Agreement will be governed by and interpreted in accordance with the law of Queensland and you agree to the jurisdiction of the courts of Queensland to determine any dispute arising out of this Agreement.

6.1 You acknowledge reading this Agreement, the Motivated Vendors Internet Privacy Policy, together with any additional terms, conditions, notices and disclaimers contained elsewhere on the Website.
